The order confirmation records your request. A contract is formed when we confirm dispatch.
Franks Clothing legal terms
The terms for shopping with Franks.
These terms explain how orders are formed, how payments and delivery work, your cancellation rights, what happens when a product is faulty and the rules for using this website.
Most standard goods can be cancelled within 14 days after delivery, subject to the rules below.
Your statutory rights apply when goods are faulty, not fit for purpose or not as described.
Send your order number through the contact page when you need help with a purchase.
These terms apply to purchases from franksclothing.com and to use of the website. They do not remove rights given to consumers by law. Read them with the Returns & Refunds Policy, Shipping Policy, Privacy Policy and Cookie Policy.
About Franks Clothing
Franks Clothing is the trading name used for this online store. In these terms, “Franks”, “we”, “us” and “our” refer to the legal person or company operating the store.
You can send a customer-service or legal enquiry through the contact page.
Using this website
You may use the website for lawful personal shopping and information. You must not:
- Use the site for fraud, unlawful activity or infringement of another person’s rights.
- Attempt to gain unauthorised access to accounts, systems or non-public areas.
- Introduce malicious code, overload the service or interfere with normal operation.
- Scrape, copy or reuse substantial parts of the store without written permission.
- Use false identity, payment, contact or delivery information.
We may restrict access, cancel an account or refuse an order where there is a reasonable concern about fraud, abuse, security or a breach of these terms.
Accounts
You are responsible for keeping account credentials confidential and for activity carried out through your account. Tell us quickly when you believe an account has been accessed without permission.
Age
You must be able to enter a binding purchase contract. A parent or guardian should place the order where the intended customer cannot lawfully contract on their own.
Products, images, colours and sizing
We aim to describe and display products accurately. Screen settings, lighting and photography can make colours appear slightly different from the physical garment.
Small differences can occur in print placement, colour tone, stitching and finished measurements within normal manufacturing tolerances. These differences do not affect your rights where the goods are faulty or materially different from the description.
Size labels and finished measurements can differ between garment types and cuts. Check the product information and Size Guide before ordering.
Product availability can change without notice. Placing an item in a basket does not reserve it.
Placing an order and forming the contract
The checkout lets you review products, quantities, delivery details and the total price before payment. Check this information carefully before placing the order.
Select products, provide delivery details and submit payment through checkout.
An automated confirmation records that your order request has reached us.
Payment, product availability, address details and fraud checks may be reviewed.
The sales contract is accepted when we send confirmation that the goods have been dispatched.
We may decline or cancel an order before dispatch where:
- A product is unavailable.
- Payment is not authorised.
- The price or description contains an obvious error.
- The address or order information cannot be verified.
- Fraud, misuse, resale abuse or unlawful activity is reasonably suspected.
- A delivery restriction prevents the order from being completed.
Any captured payment for a cancelled order will be returned through the original payment method.
Prices, tax and payment
Prices are shown in the currency displayed on the site. The checkout shows the product total, available delivery charges and any tax collected before you submit payment.
International customers may need to pay import tax, customs duty or handling charges where these are not included at checkout. The Shipping Policy gives more information.
Accepted payment methods are displayed during checkout. Payment may be authorised or captured before dispatch. Payment providers may run security and fraud checks.
Pricing mistakes
We may correct an obvious pricing, discount or description error before accepting an order. We will contact you when the correct price is higher and give you the choice to continue or cancel.
Delivery, ownership and risk
Delivery methods, charges and estimated timing are shown at checkout. Estimates include preparation and carrier transit and are not guaranteed dates.
Unless another timeframe is agreed, goods will be delivered without undue delay and no later than 30 days after the contract is formed.
Risk of loss or damage passes to you when the goods are delivered to you, or to a person you identified to receive them. Ownership passes after full payment and delivery.
You are responsible for providing a complete and accurate delivery address. Read the Shipping Policy for tracking, split parcels, address errors, customs, delays and returned shipments.
Your right to cancel an online order
For most standard goods bought online, you may cancel without giving a reason. The cancellation period ends 14 days after the day you, or a person chosen by you, receives the goods.
For an order delivered in separate parcels, the period runs from receipt of the final parcel. Tell us clearly that you wish to cancel before the period ends. You may use the form at the end of this page, but it is not compulsory.
After telling us, send eligible goods back within 14 days. Unless the goods are faulty or we agree otherwise, you pay the direct return cost. Contact us before posting anything so we can provide the correct instructions.
We may reduce the refund to reflect loss in value caused by handling beyond what would be permitted in a shop. Trying a garment on is permitted; wearing it for ordinary use, washing it, marking it or removing hygiene protections goes beyond inspection.
We will refund eligible payments, including the least expensive standard outbound delivery charge offered for the order. Any extra amount paid for premium delivery is excluded above the standard rate.
The refund will be issued no later than 14 days after we receive the returned goods or evidence that they were sent back, whichever happens first. We use the original payment method unless another method is agreed.
Faulty, damaged or incorrect goods
Goods must be of satisfactory quality, fit for a purpose made known to us and match their description. These statutory rights cannot be excluded by these terms.
Contact us promptly when a product arrives damaged, faulty, misprinted or incorrect. Include the order number, a description of the issue and clear photographs where relevant.
Depending on the circumstances and your legal rights, the remedy may include rejection and refund, repair, replacement or a price reduction.
Read the Returns & Refunds Policy for the practical claims process.
Personalised and custom-made products
The standard cancellation right does not normally apply to goods made to your individual specification or clearly personalised, such as a garment printed with your chosen name, wording or artwork.
This exception does not remove your rights where a personalised product is faulty, damaged, not as described or made incorrectly.
A standard Franks Clothing design is not treated as personalised solely on the basis that it is prepared after the order is placed.
Promotions, discount codes and gift offers
A promotion may have extra terms shown with the offer. Unless those terms say otherwise:
- Only one discount code can be used per order.
- Codes have no cash value and cannot be exchanged for cash.
- A code may apply only to named products, dates, customers or order values.
- Delivery charges, gift cards or sale products may be excluded.
- A code cannot be added after an order is placed.
We may withdraw or correct a promotion before an order is accepted where an error, fraud or misuse has occurred. Statutory rights remain unchanged.
Reviews, messages and customer content
Content you submit must reflect your genuine experience and must not be unlawful, threatening, discriminatory, defamatory, misleading, infringing or contain malicious code or another person’s private information.
By submitting a review or image for publication, you grant us a non-exclusive, royalty-free permission to display, reproduce and format that content for the store and related Franks marketing, subject to data protection law.
We may moderate, refuse or remove content that breaches these rules, is unrelated to the product or appears fraudulent. We do not promise to publish every submission.
Intellectual property
The website, branding, product artwork, photography, copy, graphics and software are owned by Franks Clothing or used under licence. You may view the site and save a copy of an order or these terms for personal use.
You may not reproduce, sell, license, alter or commercially exploit protected content without prior written permission from the rights holder.
Our responsibility to you
Nothing in these terms limits or excludes liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation and your statutory consumer rights.
When you buy as a consumer, we are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care. Loss is foreseeable when it is an obvious result or both sides knew it might happen when the contract was formed.
Products sold through the store are intended for domestic and private use. We are not responsible for business losses, lost profit, lost revenue, lost contracts or business interruption arising from a consumer order.
We are not responsible for delay or failure caused by an event outside our reasonable control. We will contact affected customers where practical and take reasonable steps to reduce the effect. Your legal rights concerning delayed or undelivered goods remain available.
Personal information and cookies
We process personal information as explained in the Privacy Policy. The Cookie Policy explains storage and access technologies used by the site.
Changes, transfer and severability
The terms applying to an order are the version available when that order is placed. We may update the website terms for future use to reflect service, supplier or legal changes.
We may transfer our rights or obligations under a contract to another organisation, but this will not reduce your rights. You may transfer your rights only where we agree in writing or the law permits it.
Each paragraph operates separately. When a court finds one part unlawful or unenforceable, the remaining parts continue to apply.
A delay in enforcing a right does not waive that right. No person other than you and Franks Clothing has a right to enforce the sales contract.
Governing law and disputes
These terms and contracts made through the store are governed by the law of England and Wales, subject to any mandatory consumer protection that applies where you live.
Consumers living in England or Wales may bring proceedings in the courts of England and Wales. Consumers living in Scotland may use the Scottish courts. Consumers living in Northern Ireland may use the Northern Irish courts.
Contact us first so we can try to resolve a complaint directly.
